FOR GOOD AND VALUABLE CONSIDERATION, including the opportunity to have my vehicle tuned and/or operated testing on a dynamometer (collectively “Services”), the receipt and sufficiency of which are hereby acknowledged, I on behalf of myself, my heirs, executors, administrators, affiliates, partners, agents or assigns (“Bimmer”) from any loss or liability that may results from the work.

Customer acknowledges the he or she is at least 18 years of age and that Bimmer would not provide the Services without having this form signed by an adult. Customer grants permission for Bimmer to operate the vehicle in any manner that Bimmer deems appropriate, including operation on and off the dyno equipment. Bimmer has made no representations other than those expressly made herein. No warranties or guarantees have been made to Customer. Customer expressly acknowledges and understand the following: Tuning a vehicle alters the control system. This may result in performance that is outside of manufacture specifications. Tuning may void manufacturer or aftermarket warranties. Bimmer makes no representations as to any manufacturer or aftermarket warranty and has no responsibility for the loss of any warranty coverage.

Customer is responsible for obeying all federal, state, and local laws, ordinances and regulations regarding emission controls and noise. Bimmer makes no representations or warranties about weather Customer’s vehicle will comply with such rules following provisions of the Services. RACE ONLY TUNE: If the preceding box has been checked, Customer has stated that the Services are requested for a vehicle used only for sanctioned racing, not for use on public streets or highways. By initialing here, Customer represents and warrants that this statement is true. Vehicles may suffer serious and catastrophic damage during or following the provision of the Services. A dyno pushes a vehicle and many of its mechanical components to critical levels that may cause failure of those components. Damage caused to automobile components may not be apparent, even upon close inspection. Automobiles are inherently unpredictable and unsafe, and operating or riding in a vehicle can lead to serious injury or death. Customer assumes all risk of loss or damage to his vehicle or person associated with the Services.

CUSTOMER IS RESPONSIBLE FOR DETERMINING THE ROAD WORTHINESS AND SAFETY OF HIS VEHICLE AFTER THE SERVICES. CUSTOMER EXPRESSLY ACKNOWLEDGES THAT BIMMER IS NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE TO HIS VEHICLE OR PERSON AS A RESULT OF THE SERVICES AND HEREBY RELEASES, DISCHARGES, CONVENANTS NOT TO SUE BIMMER FOR ANY AND ALL CLAIMS ARISING AS A RESULT OF THE SERVICES.

I have read the foregoing document in its entirety and understands the terms and conditions contained herein. This release is continuing in nature and shall apply to this and any other vehicle I own or have control over which I deliver to Bimmer. If I desire to terminate this release, I will do so in writing and will deliver the said termination to Bimmer via Certified Mail of the United States Postal Service, return receipt requested.
